Commission challenges Hungary again before the European Court

BRUSSELS (ANP) – The deterrent effect for human traffickers is also lost as they no longer have to go to jail, says the European Commission.
Hungary adopted the decree in April 2023. Since then, people convicted of human trafficking are released from prison, even if they have only served a small part of their sentence. They must leave the country within three days and serve ‘reintegration detention’ in their home country. The implementation of this is not guaranteed.
Hungary introduced the measure because Brussels does not contribute to the costs of border control, but Hungary punishes when prisons are full, Hungarian ministers argued earlier. The country released over 1400 human traffickers with foreign nationality in April 2023, among others, to make room in the prison.
This led to great irritation at the European Commission and neighboring country Austria. Repeated requests from the European Commission to Hungary to withdraw the measure have not been followed by Hungary.
